visa waiver adjustment of status

Does an American need a fiance visa to marry a UK citizen in England?

Hey there.

I’m wondering if the laws in England are similar to the USA concerning being able to marry someone without providing documentation of a fiance visa. Basically, if a US citizen was to travel to the UK on the visa waiver program, could they legally marry someone there? In the states, this is quite common. Often, foreigners will visit the USA on a visa waiver, marry an American citizen, then apply for adjustment of status.

Furthermore, if the US citizen was to leave the UK after being married, would it present any problems applying for a UK Marriage visa?

I’d appreciate any information you could provide me with. I would love to hear from anyone that has personal experience with this :) Thanks!

You need to enter UK on Fiance visa to get married there. Details can be got from UKVISAS website (I printed below)

Someone said COA (Certificate of Approval), it is not applicable to those who enter UK on 180 days tourist entry/visa. COA can be applied by the people who are already living in UK for 185 days or more (people on student/work visas mainly). (There are cases it was even issued to over stayers, but then they were traced & deported before they got married).

So in your case, you can only get married in UK, if you get a fiance visa. But in my opinion, if ur Fiance is UK citizen then better inviting them to USA & getting married there in USA & then apply for marriage visa for UK.

Once u marry in UK on Fiance visa, then u can apply for adjustment of status in UK (without leaving) and u will be given two or five years spouse visa (depends upon HomeOffice for the duration of spouse visa granted).

Good luck
